What is an Expert Advisor?
An Expert Advisor provides expert support on a specialist or technical matter within their field of expertise; however, they do not provide expert evidence to the courts.
The role of an Expert Advisor is different to that of an Expert Witness in that it is an advisory role focused on supporting the development of a robust defence or claim for the instructing party. Once a biased or partisan role has been adopted the advisor can no longer properly serve the court as their overriding duty to the court has been nullified. In the case of a dangerous dog incident an expert may provide investigative support by acting as an Expert Advisor to the team investigating the circumstances surrounding alleged breaches of Dangerous Dog Legislation.
Expert Advisors can be instructed by any individual or agency seeking specific expertise and the input of an Expert Witness outside of the court. For instance, an instructing solicitor may request an Expert Advisor to investigate the details of a case and provide an interim report on specific matters.
